  • The following Terms&Conditions govern the online purchase made through the website www.Lubar.it owned by the company Magma Srl and managed by it. Magma Srl is hereinafter referred to as Lubar.it.

    The following Terms&Conditions constitute an agreement between Lubar.it and you, the visitor, governing your access and use of any content and functionality available at the www.Lubar.it website.

    By accessing any part of this Website, you shall be deemed to have accepted this legal notice in full. We may revise this legal notice at any time by updating this posting. You should check this Website from time to time to review the then current legal notice, because it is binding on you.

    The Contract
    By filling out the appropriate order form and by forwarding it to the Seller following the available online instructions, you will be requesting the purchase of the specified items in the order form at the conditions detailed in the order proposal and in these Terms & Conditions. The contract will be concluded only with the acceptance of the order on behalf of the Seller which will be sent to you electronically to the email address indicated on the order form and which will include a copy of these Terms & Conditions. To proceed properly with the purchase we invite you to follow this procedure:

    1. Read carefully the following Terms & Conditions found through the specific link on the order form remembering to print or save a copy for future reference. If you don’t agree to any one of the conditions in the Terms & Conditions we invite you not to make any purchase with the Seller;
    2. In order to consider carefully your purchase choice, the order form includes a summary of all the relevant information: identity of the Seller; the main characteristics of the ordered products; final purchase price including taxes and charges and relative terms of payment; delivery terms and fees.
    3. Fill out carefully all the required fields in the order form; in case of errors you will be able to make the necessary corrections before the final placement of the order.

     

    The purchase of the products on sale on the Website is reserved to adult physical persons according to Italian law (18+) and who intend to purchase the products on sale not for any purpose linked to their own professional activity but purely as end consumers. The Seller reserves its right to refuse orders received in the following cases:

    1. the order is incomplete or it hasn’t been filled in properly
    2. the delivery address indicated on the order isn’t located in one of the Countries reachable by the Seller or if it’s located in a Country different from the one where the order was made;
    3. the ordered products are no longer available; in this case we will notify you that the order wasn’t accepted as soon as possible and in any case within 30 days from the day after the order was placed on your behalf.

    The Seller also reserves its right to not process any future transactions with clients who have given proof of unreliability upon receipt of the products. The language for the finalisation of the contract is English. Once the purchase is finalised we will send you a confirmation email with the summary of all the information already specified in the order form and the link to the Terms & Conditions, therefore you will receive: general information on the Seller, main characteristics of the ordered products, price including taxes and fees, delivery terms and fees, conditions for withdrawal along with times and methods for the return of the products. In any case the orders received and the relative Terms & Conditions will be preserved in electronic format by the Seller for the appropriate fulfilment of the contract and in accordance to law; you will always have access to your order status through the dedicated section on our Website.

     

    General provisions
    If any term or condition of the present agreement is invalid, against the law, ineffective or not executable according to the local law, the specified invalidity, illegality ineffectiveness or non-executability will not undermine the other valid, lawful, effective and executable terms and conditions that will remain valid and applicable between the parties. In case of invalidity, illegality, ineffectiveness or non-executability, in order to achieve a result as close to the one intended by the parties, the parties will negotiate in good faith on how to substitute the flawed arrangement and in case of failure to reach an agreement the final decision will be up to the competent judge according to the law.

    The Seller retains its right to not sell its products to certain specifically selected buyers, for example in the case of purchases made by persons that the seller considers under its own rightful judgement to be abusing or that have already abused of the online sales service. This right is reserved to the Seller in order to prevent abuse and will not be exercised with the intent to discriminate on the base of sex, race, language, religion, political opinions and or personal or social conditions.

    Applicable law and jurisdiction
    The transaction relative to the order proposal, once accepted by the Seller, constitutes a valid contract between the Seller and the client.
    The Contract is subject to Italian Law and the competent Judge for the settlement of disputes directly or indirectly related to the interpretation, the conclusion and execution of the Contract and of the Terms & Conditions will be the Court of Milan unless the applicable law states otherwise.

  • Through the Website it’s possible to purchase LùBar branded products and products of other brands carefully selected by Lubar.it and verified for quality. The main characteristics of the products are detailed in each Product Description. Please keep in mind that the images and colours as seen online could appear differently from the real ones due to the quality of the browser used or the monitor of the device used. It is understood that in these cases eventual differences found can’t be considered as a lack of conformity of the purchased product. For any further information on the quality or characteristics of our products our customer service at customercare@lubar.it is always at your disposal.

  • Create your account on our website to view and manage all your orders. You can also sign up during check-out.

    Subscribe to periodically receive LùBar products such as our Lùdoliva Olive Oil. You can unsubscribe at any time by sending an email to costumercare@lubar.it or if you are registered you can manage your subscription by accessing your private area.

  • 1.Payment
    The credit cards that are accepted as payment in the Lubar.it Online Shop are as follows:  Visa, Mastercard, American Express, Alipay e Paypal.

    When paying by credit card, you will be asked to enter your card details in a secure electronic banking system, provided by Stripe.
    Invoicing is available only during check out.

    When buying online, you can be safe in the knowledge that your payment has been processed in a secure manner; we guarantee the highest security level for every purchase made through our site as all transactions on our site are made using a encryption protocol (certificate SSL 3). Your security is of the highest importance to us; you will not be subject to any compromise and your details will not be shared with any third parties.

    2.Charge
    At the time of the order, the transaction will be processed instantly. The credit card used will be charged at the time of purchase even in the case of pre-order although the shipment of the pre-order items takes place later in the season. Payment takes place directly on our bank’s server.

    3.Refound

    Refunds will be issued to the same Credit Card that was used to place your order. After our warehouse receives the products that you have returned, and confirms that all of the requirements have been met, you will receive a confirmation e-mail. Refund will be credited within 14 days from the date of your notice of withdrawal, and credited to the account that you initially used to make the purchase. Please be aware that the time that you refund takes to process will depend on the policy of your Credit Card company.
    The refund will be issued in the same currency as the original purchase. Any differences in the amount due to the exchange rate fluctuation cannot be reimbursed.

  • 1.Coutries
    The Lubar.it Online Shop is currently open within Europe. Please be aware that at present we can only ship to the following countries:  Austria, Belgium, Bulgaria, Cyprus (excluding turkish territory), Czech Republic, Denmark (excluding the Faroe Islands), Estonia, Finland (excluding the Aland island), France (excluding overseas territories such as Guadalupa, French Guyana, Martinica, Réunion and Corsica), Germany (excluding Helgoland island and Büsingen territory), Greece (excluding Monte Athos), Hungary, Ireland, Italy (excluding Livigno, Campione d’Italia and the Italian shores of Lake Lugano), Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain (excluding the Canary Islands, Ceuta and Mililla), Sweden, United Kingdom (excluding the Channel Islands). Unfortunately, our courier cannot deliver items to PO Box addresses.
    You will be asked to specify the country of destination at check out. Countries not included in the list are not reached by our ecommerce service.

    2.Shipping Time and Costs

    Express delivery Italy 4-5 working days.
    Express delivery Italy Islands 5-6 working days.
    Standard delivery Europe 4-5 working days.
    Fast delivery Milano 1-2 working days (available only for some products).

    For BeSpoke products shipping times are specifically indicated in the product page and may be subject to longer times.

    Please note that delivery times run over working days only, and holidays are not considered within the timing allocation. The national holidays that are respected by the Lubar.it Online Shop are as follows:  1st January, 6th January, 25th April, 1st May, 2nd June, 15th August, 16th August, 1st November, 7th December, 8th December, 25th December and 26th December.

    Shipping costs will be calculated precisely at the time of checkout.

    3.Tracking of shipping and delivery
    You can track the delivery of your order at any time by using the Tracking Number that was sent to you along with the confirmation of your order.
    For Fast Shipping to Milan, once the delivery receipt email has been received, the goods will be delivered within 5 hours.
    For any problem related to tracking, the customer service costumercare@lubar.it will do everything possible to update you on the status of your order in the shortest possible time.

    The courier delivers from Monday to Friday during office hours, and unfortunately it is not possible to pre-book delivery times. In the event that the courier is unable to deliver the order, the products will be sent back to the Lubar.it warehouse and a notification will be left.

    When the item is delivered we kindly ask you to check the status of the package before signing the delivery confirmation.

    4.Returns

    If you wish to return or exchange an item please email customercare@lubar.it before sending the item back.
    Merchandise must in any case be returned within 14 days from the delivery date for a full refund.
    Merchandise must be returned in its original condition with the same box all tags attached.
    Items that are returned with signs of wear or delivered to our returns department outside the 14-day window will be sent back to the original address.
    All items are final sale and any discounted items are also considered final sale.

    Please note that Lùbar is not responsible for the cost of shipping related to the return, unless the item is defective and the defect is recognized by Lùbar, to ascertain the defect, pictures must be sent which clearly attest to the defect. If food packs undergo slight dents during transport, this will not be considered a reason for return and reimbursement as the food product is not altered by such possible bruises during the transport of the pack.

    Please allow 14 days for the refund to be processed. Make sure your name/order  is in the package and include any paperwork if available. Thank you for understanding, please contact us at customercare@lubar.it if you have any concerns.

    Please remember that there is no refund on products that are handcrafted and made to order unless they present obvious defects.
